According to CBS Sacramento, Jaclyn Kazemba and her two sons were traveling along Forty Mile Road on Friday when their vehicle collided with another car in front of the Hard Rock Casino. The CHP reported finding Kazemba’s vehicle down an embankment at the scene. The driver of the other vehicle also suffered major injuries.
“I believe that road needs to be more safe,” Kazemba said from her hospital bed. “I don’t want anybody to go through what I’m going through. All I could think about was my kids.”
Kyle, 9, and Nicholas, 13, required specialized pediatric care and were airlifted to UC Davis Medical Center in Sacramento. Kyle suffered broken bones in both legs and has undergone surgery but is expected to recover. Nicholas remains in critical condition in a medically induced coma after experiencing broken bones and brain swelling.
“He’s already had two surgeries to keep the swelling down, and he’s still trying to fight for his life,” said the boys’ father, Ramon Deltoro.
The crash came just one week after a woman in a wheelchair was struck and killed near the same location on Forty Mile Road, raising urgent questions about road safety in the area.
The CHP reports that over the last four years, Forty Mile Road near the Toyota Amphitheatre and Hard Rock Casino has seen two deaths, seven serious injury crashes, and 25 minor injury crashes. The road lacks basic safety infrastructure including adequate lighting and sidewalks.
Both the Kazemba family and the family of the woman killed the previous week are calling for urgent safety improvements. “They need more lights, traffic lights. I don’t want another family to ever go through this pain,” Deltoro said.
Yuba County officials have indicated that an entertainment zone is planned for the area in the future, with safety improvement projects included. However, affected families say they cannot wait for long-term plans when lives are at stake now.

When a road lacks basic safety features like proper lighting, signage, guardrails, or traffic controls, the government entity responsible for maintaining that road may bear some liability for crashes that occur. In California, government liability for dangerous road conditions falls under Government Code Section 835.
To establish a claim against a government entity for a dangerous road condition, a victim generally must show:
Given the documented history of crashes on Forty Mile Road, including two fatalities and multiple serious injuries, there is a clear record that suggests the road’s dangers were known. An experienced personal injury attorney can investigate whether government negligence contributed to the crash.
Victims of serious car accidents in the Sacramento region and Yuba County have the right to pursue compensation from at-fault parties. This may include claims against other drivers, government entities responsible for road maintenance, or other negligent parties.
Compensation available to car accident victims may include:
When children are injured in car accidents, the legal process involves additional protections. Any settlement on behalf of a minor must be approved by a court to ensure it serves the child’s best interests.

The crash on Forty Mile Road is a stark reminder that road safety is not just about driver behavior. Infrastructure plays a critical role in preventing accidents and reducing their severity. California roads that serve high-traffic entertainment venues and commercial areas must be designed and maintained to protect all users, including families traveling with children.
Key safety measures that can help prevent crashes on dangerous roads include:
Until improvements are made, drivers traveling on Forty Mile Road and similar rural roads near entertainment venues should exercise extra caution, reduce speed, and remain alert for changing road conditions.
Yes. Under California Government Code Section 835, you may be able to file a claim against a government entity if a dangerous road condition contributed to your accident. However, claims against government agencies have a shorter filing deadline. You must file a government tort claim within six months of the incident. An attorney can help you navigate this process.
Seek immediate medical attention for your child. Document all medical treatment and expenses. Contact a personal injury attorney who has experience with cases involving minors. In California, any legal settlement on behalf of a child must be approved by a judge to protect the child’s interests.
The statute of limitations for most personal injury claims in California is two years from the date of the injury (California Code of Civil Procedure Section 335.1). If a government entity may be liable, you must file a government tort claim within six months. For minors, the statute of limitations is typically tolled (paused) until the child turns 18.
California follows a comparative negligence system, meaning each party is responsible for their share of fault. Even if you were partially at fault, you may still recover compensation. Your damages would be reduced by your percentage of fault. For example, if you were 20% at fault and your damages total $100,000, you could still recover $80,000.
